Terms and Conditions

These are the Terms and Conditions for the PagerDuty AWS Summit Selfie Skill Promotion (“Promotion”) to be held at the AWS Summit in Sydney from 10 -12 April 2018 (“AWS Summit”).

Eligibility

  1. The Promoter is PagerDuty Pty Ltd (ABN 43 619 158 753) of 5 Martin Place, Sydney NSW 2000.
  2. Information on how to enter the Promotion and the prize form part of these Terms and Conditions.
  3. Participation in this Promotion is deemed to be acceptance of these Terms and Conditions.
  4. Entry into the Promotion is only open to Australian residents over the age of 18 who are registered to attend the AWS Summit in Sydney 2018 (“Entrants”)
  5. Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de- facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  6. The Promotion is a game of skill and commences at 7.00am AEST on Tuesday 10 April 2018 and ends at 2pm AEDST Thursday 12 April 2018 (“Promotion Period”).
  7. To be eligible to enter the Promotion, Entrants must:
    1. visit the PagerDuty booth in the Industry Zone to get their AWS Summit registration badge scanned by a PagerDuty team member during the Promotion Period; and
    2. take a selfie photo wearing a PagerDuty T or using the PagerDuty props and post it on Twitter or LinkedIn using #Relax #PagerDuty #AWS Summit (“Entry”)

Promotion Prizes

  1. There will be two prizes awarded to 2 Eligible Entrants who are selected in accordance with the Prize Conditions.
  2. Each prize will be one Kintech Mini 36V/6.4AH Electric Scooter valued at AUD $865 each.
  3. The total prize pool value is AU$1,730

Promotion Prize conditions

  1. Entrants must submit Entries within the Promotion Period.
  2. Photos must be taken of the Entrants in the PagerDuty T.
  3. Entries with photos of items of clothing featuring other product names or logos may be disqualified at the discretion of the Judging Panel.
  4. Photos must be submitted in good resolution.
  5. The Entrants consent to use of the before and after photos for voting purposes.
  6. Entries submitted after the Promotion Period ends will not be accepted.  The Promoter does not accept any responsibility for late, lost or misdirected Entries.
  7. All Entries become the property of the Promoter.  The Promoter reserves the right to verify the validity of Entries and to disqualify any Entrant who tampers with the Entry process or who submits an Entry which is not in accordance with these Terms and Conditions.
  8. The Promotion will be judged by the Judging Panel selected by PagerDuty who will select the two winning entries based on the most skilfully shot photos which contain the elements of creativity, humour and marketing ingenuity.
  9. There will be two Winners judged by the Judging Panel which in the judges view best meet the selection criteria in clause 18.
  10. Winners will be announced at the PagerDuty Xero presentation at 2.45pm AEDST on Thursday 12th April 2018.
  11. In addition to announcing the Winners at the AWS Summit in accordance with these Terms and Conditions, the winner will also be announced on the PagerDuty website pagerduty.com
  12. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age, place of residence) and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the Entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  13. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
  14. The Promoter’s decision is final and no correspondence will be entered into.
  15. Prize is not transferable or exchangeable and cannot be taken as cash.
  16. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  17. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
  18. Any cost associated with accessing the internet is the Entrant’s responsibility and is dependent on the internet service provider used.
  19. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
  20. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) collection and/or use of the prize.
  21. As a condition of accepting the prize, the Winner must sign any legal documentation required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  22. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at http://www.pagerduty.com.  Entry is conditional on providing the requested personal information. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity and research purposes, including sending electronic messages or telephoning Entrants. Entrants should direct any request to opt out, or access, update or correct information to the Promoter and direct any complaints regarding treatment of their personal information according to the Privacy Policy. All entries become the property of the Promoter. The Promoter will not disclose personal information to any overseas entity except to the Promoter’s holding company or any corporate affiliated company.
