Acceptable Use Policy

Your access and use of the PagerDuty Services and/or Website (collectively referred to herein as “PagerDuty Services”) is subject to this Acceptable Use Policy (referred to herein as “Policy”). Capitalized terms have the meaning stated in the underlying agreement applicable to your role as customer, website user, and/or Community member (referred to herein as the “Agreement”). To the extent there are conflicts between this policy and the applicable Agreement, the terms of the Agreement shall take precedence. PagerDuty may update this Policy by posting an updated version at www.pagerduty.com/acceptable-use-policy/, and such updates will be effective upon posting. By using or accessing the PagerDuty Services, you agree to the latest version of this Policy.

You shall use the PagerDuty Services exclusively for authorized and legal purposes, and in compliance with all applicable laws, rules, regulations, and license restrictions. You are responsible for all violations of this Policy, by anyone using the PagerDuty Services with your authorization, or using your account, whether such use of your account is authorized or not.

Prohibited Activities

You shall not use the PagerDuty Services to do any of the following:

• Interfering with or impairing the intended operation of the PagerDuty Services;
• Violating (or helping or encouraging others to violate) the Agreement or PagerDuty’s policies;
• Engaging in any illegal, fraudulent, or abusive activity, including any activities or in violation of any federal, state, local or international laws or regulations (including without limitation, any of the foregoing relating to data, privacy, publicity rights, export control, and protection of civil rights);
• Any unsolicited or harassing notifications or messages (commercial or otherwise), including unsolicited or unwanted SMS messages or emails, or an excessive quantity of SMS messages or emails;
• Impersonating others or providing inaccurate or misleading information;
• Sending altered, deceptive, or false source-identifying information, including “spoofing” or “phishing”;
• Creating a false identity or forged email address, phone number, or otherwise attempting to create alternative users;
• Providing support or resources (or concealing or disguising the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act or other laws and regulations concerning national security, defense, or terrorism;
• Using the PagerDuty Services for purposes of benchmarking or other competitive purposes, including building a competitive product, service, or solution.

Security and Disruption

You shall not attempt to bypass or break any security mechanism on any of the PagerDuty Services, or use the PagerDuty Services in any other manner that poses a security or service risk to PagerDuty or any of its other customers, including but not limited to:

• Any material or content that infringes, dilutes, misappropriates, or violates the intellectual property rights, proprietary rights, or other rights of third parties, including but not limited to copyrights and rights arising from patents, trademarks, and trade secrets;
• Any material or content that is illegal, fraudulent, threatening, obscene, indecent, pornographic, or serves to promote human trafficking or harm to minors;
• Any material or content that is false or inaccurate, defamatory, libelous, incites or facilitates credible threats to personal or public safety, or promotes hateful action against anyone based on race, ethnicity, national origin, sexual orientation, sex, gender, disability, religion or other legally protected category;
• Any material or content that violates someone else’s rights, including privacy, publicity or data rights;
• Any personal data without permission;
• Any sensitive personal data such as credit card and payment information, or Protected Health Information as defined by the Health Insurance Portability and Accountability Act of 1996 as amended, or other types of personally identifiable information or highly-regulated data, including driver’s license numbers, passport numbers, social security numbers or financial information.
